TERMS AND CONDITIONS FOR AYUSKA HEALTH PLUS


These Terms of Use govern the use of the services and software offered by AYUSKA HEALTH PLUS, a company having its registered office in Ahmedabad, Gujarat, hereinafter referred to as the “Company”.
 

1. Acceptance of Terms


By accessing the website, mobile application, or using any services provided by Ayuska Health Plus (collectively, the "Platform"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, you are not permitted to use the Service.

2. Nature of Service


The Platform acts as a facilitator connecting:
Clients: Individuals seeking healthcare, caregiving, or wellness services.
Care Partners/Providers: Independent contractors or staff providing the services.
The Company provides a platform for enabling connections but does not directly provide medical advice. Reliance on any information provided by the Company or its partners is solely at your own risk.

 

3. Limitation of Liability


To the fullest extent permitted by law, Ayuska Health Plus and its affiliates shall not be liable for:
Any indirect, incidental, or consequential damages.
The conduct, whether online or offline, of any User (Client or Provider).
Property damage or bodily injury resulting from services performed by independent contractors.
Aggregate Liability: In no event shall the Company’s total liability exceed the fees paid by you to the Company in the one (1) month period prior to the claim.

 

4. Safety and Service Rules


Verification: While the Company performs background screenings, the actions of the assigned personnel are their individual responsibility.
Payments: Clients are strictly advised not to make direct cash payments to care providers. All financial transactions must go through the Company’s authorized channels. The Company is not responsible for any monetary loss resulting from direct dealings.
Replacements: In case of dissatisfaction, the Company will endeavor to provide a replacement within 7 days, subject to availability.


5. Cancellation and Refund Policy


Membership/Orders: Cancellations are considered only if requested immediately after placing the order and before the service process has been initiated.
Perishables/Specific Items: No cancellations are accepted for perishable goods once dispatched.
Refund Processing: Approved refunds will be processed within 3-5 business days to the original payment method.
Cancellation Fee: Services canceled by the member on the same day of the scheduled visit may incur a cancellation fee (e.g., ₹300 or as specified on the Platform).


6. User Representations


By using this service, you certify that:
You are at least 18 years of age.
All information you provide is truthful and accurate.
You will use the service for lawful purposes only and will not attempt to harm or disrupt the Platform's operations.

 

7. Intellectual Property


All content on the Platform, including logos, text, graphics, and software, is the exclusive property of Ayuska Health Plus. Users are granted a limited, non-exclusive license to use the Platform for personal use only. You may not reverse-engineer or copy the Platform’s features.
 

8. Governing Law and Jurisdiction


These Terms and Conditions are governed by the laws of India. Any disputes arising from these terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts located in Ahmedabad, Gujarat.
 

9. Modifications


The Company reserves the right to change these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the new Terms.
